Care Plan Terms

Version: v1.0 · August 21, 2026

These Terms govern the Care Plan provided by JackGranatowski.com – Jacek Granatowski (“Contractor”). These Terms are incorporated into the General Service Agreement (“GSA”) by reference (GSA, “Precedence”) and prevail over it on ongoing maintenance. Notices, confirmations, acceptances and terminations require written form, and written form includes email and a message sent through a client-communication tool designated by the Contractor. Days mean calendar days. A Business Day means a day from Monday to Friday, excluding public holidays in Poland.

§ 1 Formation

  1. The Client confirms the Order by designating the selected tier and the website. The Contractor issues the first invoice upon confirmation of the Order. The Plan activates upon payment of the first invoice. For the CUSTOM tier, the parameters set out in Annex 1 are confirmed by the activation email.
  2. Tiers CORE, COMMERCE and CUSTOM are priced in accordance with the price list at https://codeslash.net/pricing. The Parties confirm the price applicable to a given Order in the communication concerning that Order. The CORE tier and the COMMERCE tier each cover one website. The Client may hold several Plans, one for each website. The CUSTOM tier may cover more than one website under a single Plan, to the extent set out in Annex 1.
  3. Free period. Where the Parties have agreed a free period, its terms are set out in the Order or the Proposal. A free period does not convert into a paid Plan without the Client’s confirmation.

§ 2 Period and termination

  1. The length of the period depends on the tier selected. Under a monthly Plan, the period is a calendar month. Under an annual Plan, the period is twelve consecutive calendar months. For the CUSTOM tier, Annex 1 may fix another period. The period runs from the first day of the calendar month following activation of the Plan. The time from confirmation of the Order to the first day of that month is billed under §6.1. A monthly period renews for a further calendar month. A period exceeding one month does not renew, unless the Order expressly provides for its renewal.
  2. Either Party may terminate the Plan at any time. Termination takes effect on the last day of the period in progress. Until that day the Contractor performs the Plan in full.
  3. The fee for the period in progress is not reduced or refunded. The first sentence applies also where the Client ceases to use the Plan. For a Client benefiting from consumer protection, settlement is made in accordance with Annex 1k to the GSA. In respect of such a Client, this paragraph applies only up to the remuneration for the delivered part of the period.
  4. The Plan is a contract for services (Art. 750 of the Civil Code). In respect of a Client not benefiting from consumer protection, the Parties exclude Art. 746 §1 of the Civil Code. In respect of such a Client, termination of the Plan takes place solely under §2.2. The right to terminate for important reasons (Art. 746 §3 of the Civil Code) remains unaffected.
  5. Payment for the delivered part of the period only is due in each of the following cases:a) termination of the Plan by the Client for important reasons (Art. 746 §3 of the Civil Code);
    b) termination of the Plan by the Contractor before expiry of the period in progress;
    c) termination of the Plan by the Client following an amendment to these Terms taking effect immediately under §3.3;
    d) termination of the Plan following an objection by the Client to a sub-processor where no alternative has been agreed (DPA, “Sub-processors”);
    e) termination of the Plan by reason of force majeure under §6.4;
    f) termination of the GSA, referred to in §2.6.The Contractor refunds any amount exceeding the payment for the delivered part of the period within 14 days.
  6. Termination of the GSA terminates the Plan at the same moment. Settlement is made under §2.5.
  7. Where the Order provides for the renewal of a period exceeding one month, the Contractor notifies the Client of the forthcoming renewal no later than 14 days before expiry of the period in progress. The Client may terminate the Plan with effect on the last day of the period in progress. Absent that notice the period does not renew, and the Plan lapses on the last day of the period in progress.
  8. The annual price includes a discount earned by completing the full twelve-month period. Where an annual Plan ends before expiry of that period, the delivered part of the period is billed at the monthly rate and the discount does not apply. For a Client benefiting from consumer protection, the amount due does not exceed the value calculated pro rata to the annual price.

§ 3 Amendment

  1. A material amendment is the removal or narrowing of a category set out in §4.1. Fees are governed by §6.2. No other change is an amendment to these Terms. The Contractor selects the tools, providers and implementation delivering a given category and may replace them at any time, without notice and without the Client’s consent, provided that the category is still delivered.
  2. A material amendment requires a valid reason. A valid reason is a change of law or of its interpretation, an organisational or technological change on the Contractor’s side, and a change in a provider’s scope, cost or availability. The Contractor notifies active Clients of a material amendment. The amendment takes effect on the first day of the second calendar month following the notice. Where a period exceeding one month is in progress at the time of the notice, the amendment takes effect from the following period.
  3. An amendment takes effect immediately where law so requires, or where a provider ceases to make a category available and no equivalent category exists. The Contractor notifies the Client of such an amendment without undue delay. The Client may terminate the Plan within 14 days of that notice, settled under §2.5.

§ 4 Services

  1. The Plan comprises the categories set out in the table below. For the CUSTOM tier, Annex 1 governs.

  1. The included hours cover any work requested by the Client that falls within them, including remedying the effects of changes made by the Client. The included hours do not carry over to the following month.
  2. The Contractor quotes work exceeding the included hours and submits it to the Client for acceptance before that work begins. Such work is billed at the Care Plan client rate set out in the price list at https://codeslash.net/pricing, subject to the GSA (“Hourly rate lock”). Time is billed in 15-minute increments rounded up, subject to a one-hour minimum.
  3. The Contractor quotes separately any larger service that does not fall within the included hours. Where such a service modifies an approved Order, it constitutes a Change Request (GSA, “Change Request”). The Plan does not cover SEO, marketing, content strategy, or migration of hosting or CMS.
  4. A rollback restores the website from a backup selected by the Contractor. Data created after that backup was made may be lost, and its recovery is billed under §4.3. Backups are operational in character and are not handed over. The Contractor deletes the backups after the Plan ends.
  5. The first response times set out in the table below are indicative and customary. Those times do not constitute a commitment or a service level agreement, and the actual response time may be shorter or longer.

  1. Work performed at the Client’s request on an expedited basis constitutes Priority Work (GSA, “Priority Work (Rush)”). Priority Work depends on the Contractor’s availability and is subject to a surcharge of +50%. Performance of Priority Work requires the Client’s prior acceptance.

§ 5 Client obligations

  1. The Client maintains valid hosting, domain and third-party service subscriptions.
  2. The Client provides the access credentials required for maintenance work, including access to the CMS admin panel, the hosting panel and DNS.
  3. The Client responds to maintenance communications within 14 days.
  4. The Client does not modify code and does not install, remove or update plugins, themes or CMS core without prior notice to the Contractor.
  5. The Client gives the Contractor at least 14 days’ notice before changing hosting provider, server environment, PHP version or domain registrar. The Contractor is not liable for the consequences of a change made without the notice required under this paragraph or under §5.4.
  6. The Contractor’s obligations are suspended where the Client’s acts or omissions prevent performance of the Plan. Performance is prevented in particular by:a) access referred to in §5.2 being changed, withdrawn or not restored on request;
    b) the website being taken down;
    c) the lapse of a subscription referred to in §5.1.The fee remains payable for the time of suspension. The Contractor is not liable for anything arising during the suspension. The Contractor notifies the Client of the suspension and resumes performance once it becomes possible. After 14 days from that notice the Contractor may terminate the Plan with immediate effect. Settlement is made under §2.5, and the time of suspension counts as a delivered period.

§ 6 Fees, suspension and force majeure

  1. Fees are payable in advance. The fee for the time from confirmation of the Order to the start of the first full calendar month is as agreed by the Parties. Thereafter a monthly Plan is payable on the first day of each month. An annual Plan is payable in full at the start of its period. For a Client benefiting from consumer protection, the start of performance and the start of the period are governed by §7.2.
  2. The Contractor may change the fee on 30 days’ notice. The fee is fixed for the period in progress. The new fee applies from the following period. A Client who does not accept the new fee may terminate the Plan beforehand under §2.2.
  3. Failure to pay the Plan fee by the due date (GSA, “Payment terms”) entitles the Contractor to suspend the Plan until the outstanding amounts are settled. The period in progress is not extended. The Contractor is not liable for the consequences of the Plan not running during the suspension.
  4. Where an event under the GSA (“Force Majeure”) prevents performance for more than 14 consecutive days, fees are suspended for the documented duration of that event. A period exceeding one month is extended by that time. Where the event lasts more than 30 days, either Party may terminate the Plan with immediate effect, settled under §2.5.

§ 7 Consumer protection

  1. In respect of a Client benefiting from consumer protection, complaints are handled in accordance with Annex 1k to the GSA. In the matters governed by Annex 1k, it prevails over these Terms.
  2. Withdrawal. Confirmation of the Order by a Client benefiting from consumer protection is an Order within the meaning of Annex 1k, carrying a 14 calendar day right of withdrawal from the day of confirmation. The Contractor begins performance of the Plan, onboarding included, after the withdrawal period expires, and the paid period runs from that day. Beginning performance earlier requires the Client’s express request under Annex 1k. Settlement on withdrawal is made in accordance with Annex 1k.
